Do NOT reuse Apple’s standard EULA here — Fluency Write is a web app billed directly through Stripe, so it needs its own terms (this document).
1. Who we are and what these terms cover
Fluency Write is a web-based writing-feedback service for language learners, operated by Noble Fluency LLC (“we,” “us,” “Fluency Write”). By creating an account or using the service, you agree to these Terms of Service. If you do not agree, do not use the service. You can reach us at hello@fluencywrite.com.
2. The service
Fluency Write lets you submit writing and receive AI-generated feedback, including corrections, an estimated proficiency level, and suggestions. Feedback is generated automatically using a third-party AI model and may contain errors or inaccuracies. It is intended to support language learning and is not professional, educational, medical, legal, or other expert advice. You are responsible for how you use the feedback.
3. Accounts
You must provide accurate information and keep your sign-in credentials secure. You are responsible for activity under your account. You must be at least 16 years old to use Fluency Write.
4. Free tier and subscriptions
Free tier. Without a subscription, you can complete a level calibration and up to 3 correction sessions. After that, continued use of paid features requires a subscription.
Paid plans. We offer a Monthly plan at $9.99/month and an Annual plan at $79/year. Prices are in US dollars and may change with notice; changes will not affect your current billing period. Applicable taxes may be added.
Founders’ offer. A founders’ code provides a discounted first-year annual rate of $59, valid through July 13, 2026. The discount applies as described at the time of redemption; standard renewal pricing applies thereafter unless stated otherwise.
Billing and renewal. Subscriptions are billed in advance through our payment processor, Stripe, and renew automatically at the end of each billing period until cancelled.
5. Cancellation and refunds
Cancellation. You can cancel anytime through the Stripe customer portal linked in your account. On cancellation, your subscription remains active until the end of the current billing period and does not renew.
Refunds. We offer a 14-day refund on a new subscription purchase: if you request a refund within 14 days of the charge by emailing hello@fluencywrite.com, we will refund that charge. Refunds outside this window are at our discretion and are not provided automatically on cancellation.
6. Your content
You keep ownership of the writing you submit (“your content”). You grant us the limited rights needed to operate the service — to store your content, send it to our AI provider to generate feedback, and display the results back to you — as described in our Privacy Policy. You are responsible for your content and must have the right to submit it.
7. Acceptable use
You agree not to: use the service unlawfully; attempt to disrupt, reverse-engineer, or gain unauthorized access to the service; resell or redistribute the service without permission; or use it to generate or store content that is illegal or that infringes others’ rights.
8. AI-generated feedback
Feedback is produced by an automated AI system and is provided “as is.” It may be incomplete, inaccurate, or unsuitable for a given purpose. We make no warranty about the accuracy of corrections, proficiency estimates, or suggestions, and you should not rely on them as a substitute for qualified instruction or advice.
9. Service availability and changes
We may modify, suspend, or discontinue features at any time. We aim to keep the service available but do not guarantee uninterrupted or error-free operation. During the beta period in particular, features may change and data structures may evolve.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, Noble Fluency LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate your access if you breach these terms or to comply with law. Sections that by their nature should survive termination (such as content rights granted, disclaimers, and limitation of liability) will survive.
12. Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Disputes will be subject to the courts located in Washington State, unless applicable law provides otherwise.
13. Changes to these terms
We may update these terms. Material changes will be reflected in the “last updated” date above and, where appropriate, communicated to you. Continued use after changes take effect constitutes acceptance.
